COMMISSION TERMS OF SERVICE

The following Terms of Service will be effective upon commission agreement between Looking Owl Art, LLC (herein referred to as “Artist”) and the client (herein referred to as “Client”):

General

Terms of Service and Prices are subject to change at any time. The Client shall only be subject to the Terms of Service and Price at the time of the commission agreement. The Artist reserves the right to reject a commission for any reason. Commission requests that would violate any intellectual property rights will be rejected.

Payment

Upon acceptance of a commission request by the Artist, the Client will receive a communication outlining the requested scope of work for review and approval. Upon Client approval of the scope of work, Client will receive an invoice by email for 50% of the full cost of the commission. Payments will only be accepted in USD. The non-refundable deposit payment is due from the Client within 10 days to hold the commission reservation. Once the deposit invoice is paid, the commission will be started in the order of the Client waiting queue. If the deposit invoice is not paid within 10 days, the commission will be canceled and the Client will receive a notice via email communication and will lose their place in the queue.

Upon completion of commission and Client approval, Client will receive a final invoice for the remaining balance of the commission cost. Upon receipt of final payment, the commission will be sent to print production. If Client opts to pay commission cost in full prior to the start of the commission, Artist shall provide invoice for full commission cost, which will be due within 10 days.

Right of Refusal

It is the intent of the agreement that the Artist will create an artwork for the Client that the Client will purchase. However, if after the artwork is completed, the Client does not wish to purchase the artwork, the Client may refuse. In that case, the Artist will retain the artwork and the deposit, free of any claims or interests of the Client and the Client will owe no additional fees to the Artist.

Deadlines

Depending on the commission workload, the turnaround time should take approximately 3 weeks. Client will receive an estimated time for completion, and/or notification if there is a delay in completing the commission by estimated deadline. Client shall notify Artist of any specific deadline needed. Artist will make every effort to honor the deadline request, but it is not a guarantee. Clients may request a work in progress update at any time.

Revisions

It is the Client’s responsibility to communicate with the Artist regarding any discrepancies between the scope of work and the artwork execution. There will be regular intervals in which the Artist will communicate with the Client to complete the commission to the Client’s expectations. Client is entitled to two (2) reasonable revisions of the final artwork, depending on the nature and scope of work. Artist agrees to accommodate requested revisions to the best of their ability. Client agrees and understands that any revision requests will extend the original completion estimate. Revisions will be completed in a timely manner.

Copyright & Usage Policy

Commissioned artwork is for personal use only. Commercial use of commissioned artwork is prohibited. Artist retains the copyright to all artwork and the right to post on the Artist’s website or for use in website portfolios. Client will advise if the commission should remain private. Artist shall retain ownership rights to the total commissioned artwork until Client submits final payment. Upon issuance of final payment, ownership rights shall be transferred to the Client. Artist shall receive authorship credit for any Artist’s work displayed publicly or via the internet.

Exclusivity

The Client and the Artist agree that the commissioned artwork agreement shall be exclusive. The Artist agrees to exclusively create the commissioned artwork for the sole benefit of the Client. The Artist shall not reproduce in any format any commissioned artwork to benefit the Artist.

Refunds

The Artist agrees that if for any reason the Artist is unable to start or fully complete the Client commission, Client shall be refunded in full for any payment previously remitted.
